Terms of Service
These Terms of Sale (effective as of 26.1.2025) apply to the purchase of digital photographs and related services supplied by Reef Safari Photography via our online galleries (hosted on Pixieset) or other channels. Please read them carefully. Nothing in these Terms excludes, restricts or modifies rights that cannot be excluded under the Australian Consumer Law.

2) Products and licensing
a. We sell single-image digital downloads and packages. File specifications are shown at checkout and in product descriptions.
b. Licence: Upon purchase, you receive a non-exclusive, non-transferable, perpetual licence for personal use only (including personal printing, sharing with family/friends and posting on your social media).
c. Restrictions: You must not resell, sub-licence, commercially exploit, use in paid advertising, or upload files to stock libraries without our prior written consent. You must not remove copyright notices or metadata.
d. Editorial/commerical use: If you need commercial, editorial, or promotional rights (e.g. Business website, advertising), please contact us for a separate licence.
3) Pricing and Taxes
a. Prices are in Australian Dollars (AUD) and include GST where applicable. Any unavoidable fees or charges will be disclosed as part of the total price.
b) We may update pricing from time to time; changes apply prospectively to future orders only.
4) Ordering, payment and delivery
a. Orders are place through our Pixiset store. Payment is processed securely by third-party processors (e.g., Stripe); their terms may apply.
b. Delivery: Digital downloads are delivered by email link and/ or instant download after successful payment.
c. Availability window: Galleries are typically available for 8 weeks from your travel date. We recommend you download and back up your files promptly and securely.
d. Access issues: If your link expires or you have trouble downloading, contact us - we'll help re-supply the files where reasonably possible.
5) Australian Consumer Law (ACL) and refunds
a) Our goods and services come with guarantees that cannot be excluded under the ACL. If there is a major failure, you are entitled to a refund or replacement; for minor failures, we may re-supply or repair within a reasonable time.
b. Change of mind: Because digital files are delivered instantly and cannot be returned, we generally do not offer refunds for change of mind or where you purchased the wrong photo, e.g. date, gallery, image - unless required by law.
c. File issues: If a file is corrupted, not as described, or we delivered the wrong file, we will promptly re-supply, replace or refund in accordance with the ACL.
d. How to claim: Please contact us with your order number, the issue and preferred remedy.
6) Colour, cropping and technical variation
Colours are brightness may vary between screens and prints. Minor cropping or watermark removal on purchased files are normal. These variations are not defects.
7) Privacy and communications
a) We collect and handle personal information to fulfil orders and provide support, in accordance with our Privacy Policy (Australian Privacy Principles). You can request access to, or correction of, your personal information.
b)Marketing: We only send marketing emails/ SMS with your consent. You can unsubscribe at any time via the link provided on the message
8) Security
We use reputable providers and reasonable safeguards to protect your information and files. However, no method of electronic transmission or storage is completely secure.
9) Age and consent
You must be 18+ to purchase, or have parental/ guardian consent. If you appear in an image purchased by another person in your party, that person confirms they have your permission (or parental/guardian permission) to prucahse and share it for personal use.
10) Intellectual Property
All copyrights in the images remain with us. Your licence is as set out above. Nothing in these Terms transfers copyright to you.
11) Platform and third-party
Our galleries are hosted by Pixiset. Payment processing and file delivery may rely on third-party services. Your use of those services may be subject to their terms and privacy policies.
12) Liability ( to the extent permitted by law)
Nothing in these Terms excludes or limits statutory guarantees under the ACL. To the extent permitted by law, our liability for any failure to comply with a guarantee is limited to re-suppling the services or paying the cost of re-supply. We do not exclude any liability that cannot be excluded by law.
13) Fair contract terms and changes
We aim to keep these Terms fair and reasonably necessary to protect our legitimate interests. We may update these Terms from time to time; changes apply to future purchases only. For material changes, we will post the updated terms with a new effective date.
14) Disputes and complaints
If you have a concern, please contact us first so we can resolve it quickly. You also have rights to seek assistance from your state or territory consumer protection agency or the ACCC.
15) Governing law
These Terms are governed by the laws of Queensland, Australia. The coures of Queensland have non-exclusive jurisdiction.

Refunds and Problems
Digital downloads are delivered instantly and can't be returned. We don't refund for change of mind or incorrect selection, but your rights under the Australian Consumer Law apply. If a file is corruptre, not as described, or tou receive the wrong image we'll re-supply, replace or refund as required. Galleries are online for 8 weeks - if your link expires, contact us and we'll help where reasonably possible.
